I also purchased the home on 215 Watson Street as a potential home for me and my daughter, Jessica. Also as a rental/Tax write off until such time that the divorce and custody was decided in the courts .. This was purchased as my sole property:
Michael D. Small was my Father's attorney and my attorney at this time: As my father introduced me to Mike and I retained Michael to review all the legal aspects of me purchasing property in Lodi as my sole and separate property! NOT COMMUNITY, as I was waiting to finish divorce proceedings in LA: After 2 other attorneys would not get the divorce and custody process moving I fired the 2 other attorneys and hired Mike Small in 1986 to fly to LA and address some of the issues of the divorce! |

I sold the home on Watson St. to My Father and Mother for what I had paid for it... they gave me the $ I used as a down payment but they bought it for what I paid for it and the closing costs of my purchase in 1984: ….(Essentially taking over payments on a 15yr owner carry note)
Over the years they paid the home off prior to their retirement and enjoyed about $500 p/m of rental income from the property + the tax write offs etc... |
Brenda and I divorced and later we made attempts to play house again but they did not work well:
Brenda and my father were very very very close and I never threw sand into any relationship she had with my family what so ever: (See attached letter from Dad to Brenda on 6-22-1995 This letter speaks for itself!) I did not know the full details until I saw this letter in June 2009 for the first time Brenda shared it with me (and there are many like it)
Brenda would come to help my mother as my dad was dying more than ANY of my sisters and probably more than ALL of them combined, under conditions you would find hard to believe... (I was not fully aware of this at the time)
I was so deeply touched in October of 1997, just before my dad died, and the last trip I made to CA before he died (Last time I saw him alive) I put enough of a down payment on a new car for Brenda that would not be too much for her to handle on payments and she would not have to worry about breaking down and filling the radiator every 15 miles with water: I also sent Brenda some $ from Montana to help her –

A. November, My father died:
My Mother was/is not landlord material, and for the first time she had the sole record keeping and financial responsibility of her household on her shoulders. I was living in Montana building a bank, but I knew Brenda would give her honest advise and know what to do: If my Mom knew what and when to and if she WOULD ask Brenda for it.
a. After the Funeral and prior to me flying back to MT I gave my mother $2500* cash (*Mom did repay me later when she found out her financial condition was on solid ground) after the funeral as I did not know what financial condition my dad left her in. At the time she was concerned that she may have to sell the house and did not know herself the true state of affairs at that time, if she could afford to even keep this home: NONE OF MY OTHER SISTERS HELPED HER WITH A DIME! Just fuzzy “it will all be OK” banter! Thanked me for doing it .. I guess so they felt there was no need on their part!
b. As it turns out my Father left my mother totally debt free with some insurance as a cushion! + his SS + his Teachers Retirement + a supplemental medical insurance from the Church in Sacramento @ a $ value of about $200 per month + about $1000.00 per month in “ministerial aid” (this aid Mom has to apply for every year) + My mom's own retirement from teaching school for 30+ years: Nothing dramatic but much better than most or many! (I think about $3.000.00 p/m w/ no debt, car, house payments or utilities->since Aug of 2002 when I put the solar in)
B. About 7 months later I returned from Montana to Manteca, CA and then I then made several discoveries:
a. Almost ALL of the guns my father has were looted (he had a large collection/ 30+ guns) of which 3 were left in the gun safe for me: I was never given the full story only bull shit where and who got what and after asking several times I let it go not to start a family war: To this day I still do not know the answer!
b. Several other larger ticket items were missing like the Troy roto-tiller (almost brand new $1500.00) that my Brother-in-law Dean, (Kay's husband) said that mom gave to him.. I asked mom and she said that she may have shortly after the funeral when she let them go through dad's gun collection: AGAIN I did not make a fuss:
c. The girls (sisters) would and did continue to ask for things and my mother would never tell them “NO” Antique Book Cases, Other family heirloom items like 1700's candle sticks, Miniature collections, a cherry wood spool bed with wash stand...etc.. I never put up a fuss or even questioned it STUPID ME?!
d. As mom would give one thing to one of the girls the other 2 would remind mom of that and be sure to mention what they really liked in the house and how they would cherish it so very much! Especially KAY who had her hand up for anything at anytime! (Just like she did with my Grandmothers estate!) poor me I did not get a THANG! |

My mother has had enough of playing landlord and offered the long-time tenant the deal of a lifetime to purchase the home he has been renting for years: (There have only been 2 tenants in that home since I bought it in 1984) My Mom sells the rental for about $70,000 (adjusted pre-tax*) net to her: When my mom said that she was going to sell it and divide it 4 ways I did not blink or ask questions I just assumed that it would be the 4 kids – me and my 3 sisters: After my mom makes her dispersions from the sale.. all the alarms go off on the issue of “Capital Gains Taxes” Well guess what ! Guess who was the last on that line ! … So Brenda files mom a couple of extensions and the idea of the tax credits relating to installing a solar system is looked into closer: WELL, that was the magic silver bullet on paper it looked real good and in reality it was actually better than imagined: I was back from Holland and in late May 02, I started going to work on pricing and getting the package together :
The bottom line is that I installed about a $75,000+ solar system and got her electrical panel updated (The house has Aluminum Wiring- fire hazard- in much of it and in the main & Sub-panel, most of the Alum. was removed at that time and replaced with copper) ALL for about $50,000.00, of which I did a lot of the work + cut the deals + paid out of my own pocket about $10,000 for the likes of batteries, battery cables, renovation, upgrading wiring, stainless steel bolts screws, etc.. that tax credits & rebates did not cover.
The deal was! The solar system was my personal property and when my mom died, house was sold or rented I had the option of selling it with the home or removing it 90 days from the time of sale: It was NOT a part of the house-estate ** IF NOT I would have never installed it**, especially after the BS with the sale of the house, dad's guns and other items that left the house! (In my mind then, WIN WIN) I give up the $ from any claim to a share of the proceeds from the sale of Watson Street; add some sweat equity and I get a Solar system that would be worth as much if not more 10-15 years down the road and Mom has no utility bill! Again, it all had win win written all over it at 45-50k not @ $75,000+ which was the lower pricing for the same or similar system from solar contractors on a turnkey basis! (ALL the sisters were informed of this FACT! Prior to me even proceeding in 2002. They later, especially Dick-n-Louise attempted to deny this and try to use it as a diversion and bargaining chip in May-June 2009)
So my mom takes out a quick line of credit on the house to pay for the hard costs of the solar system about $40,000-$45,000 with the intent of paying it off as soon as the rebate checks came in.. 30-90 days after installing: WELL GUESS WHO KNOWS ABOUT THE MONEY AND SMELLS OPPORTUNITY and raises her hand! My sister Kay! So she talks my mom into lending her the $ from the rebates and she will make the payments on mom's house mortgage … LMAO you can see how this is going ! *Well look at the note card to from Kay to my mom in Kay's own hand writing!* (ref: SEE Kay's note cards and checks in Cat of Evd.)
Not till I find these documents my mom had put in a corner of the clutter room (AUG 2009) did I even begin to start to get the reality of what Kay had been doing for years!... and I still do not know other than what my mom's notes & checks etc tell me .. NO doubt there is much more! |
When Brenda was here visiting Mom and they were reviewing Mom's Taxes and the benefits of the Solar System in how much it was saving my mother: Mom then offered to pay my cell phone bills.. Up until this time I would pay her back: (Ref: x See Mom's hand written notes*)This has been the back bone of my sisters' and Dick's (Richard) entire diversion that I was taking advantage of my mother! After they have been looting from her for YEARS!
This is also after they thought all the records were looted and I could not prove that I paid mom back and also they refused to listen to Brenda who was here when mom made that offer! THE ONLY $ I have ever taken from mom, other than when she would toss me $20 or something just cause or whatever.. NOTHING LIKE YOU SEE WHAT SHE HAD DONE WITH MY SISTERS... BUT THEN I NEVER ASKED EITHER! |
